Phalanx Advisory Group, LLC, doing business as Phalanx Advisory Group ("Phalanx," "we," "us," or "our") respects the intellectual property rights of others and expects users of phalanxadvisorygroup.com and any related webpages, content, functionality, and services (collectively, the "Site") to do the same. If you believe that any content available on the Site infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (the "DMCA").
1. Required Information for a DMCA Notice
Your notice must include: a physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest; identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered; identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate the material; information reasonably sufficient to permit us to contact you, such as your name, address, telephone number, and email address; a statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification
If you believe that material you posted to the Site was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our DMCA Agent. To be effective, your counter-notification must include: your physical or electronic signature; identification of the material that has been removed or to which access has been disabled and the location where the material appeared before it was removed or disabled; a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification; your name, address, telephone number, and email address; and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which Phalanx may be found, and that you will accept service of process from the person who submitted the original DMCA notice or that person's agent.
4. Repeat Infringers
In appropriate circumstances and at our discretion, we may suspend or terminate access for users or account holders who are repeat infringers or who repeatedly submit content that infringes the intellectual property rights of others.
5. Misrepresentations
Any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages under applicable law.
6. Reservation of Rights
Phalanx reserves the right to remove content alleged to be infringing, disable access to such content, request additional information, and take any other action we deem appropriate in our sole discretion.
